What is immigration detention?

The Home Office may detain individuals who are awaiting removal, have overstayed, or are considered at risk of absconding. Detention may take place in an immigration removal centre, police station or prison.
There is no automatic time limit, but detention must be lawful,
proportionate and regularly reviewed.

Not all detainees are eligible for bail, and not all will require legal support to make a bail application. We review your position and give you clear legal advice before preparing any documents.

Disbursements and Additional Costs

Some immigration matters may involve payments to third parties. These are called disbursements.
They are not part of our legal fee and are usually payable directly to the provider or through us with your approval.
We will always explain any disbursement in advance so you can plan accordingly.

Timescales

We aim to prepare your bail application within five working days of receiving all required information.
If the case is urgent and documents are available, we may be able to submit sooner.

The tribunal usually lists immigration bail hearings within 7 to 14 days after receiving the application.

What happens at the hearing?

The immigration judge will review your bail application, legal representations, Home Office response, and
any supporting documents. You may be asked questions. A financial supporter should attend
to show they understand their responsibility. The judge will decide whether
to grant bail and on what conditions.

We provide full support in preparing you for this process.
Representation at the hearing is not included in the fixed fee but can be arranged on request.
